Although it is possible to get a divorce without a lawyer, it is usually not advisable unless the divorce is mutually agreed upon by the couple and they can agree on all the splitting of the property and the custody rights. This is usually not the case, so a divorce lawyer is called upon to help to settle the proceedings and make sure everything is properly filed with the court of law. Individuals will often look for a cheap divorce lawyer so that they do not have to pay so much money to have the divorce finalized. However, a cheap divorce lawyer is usually one that does not have much experience or who will end up spending more time settling the case and thus end up charging the individual as much as a more expensive lawyer would for half the time.

What to Expect

There are free online forms to fill out to file and obtain the divorce, so it seems that a cheap divorce lawyer would suffice in that situation. However, when there are disputes in the divorce about fault or settling the property or child support, it is better to find a quality lawyer rather than a cheap divorce lawyer. When finding any lawyer, there are usually two types of fees that will be written out in the retainer agreement. There are some fees that are flat rate fees, meaning that the lawyer knows the amount of time that he will spend on certain documents and certain motions, so he can tell the individuals how much that part will cost up front. A cheap divorce lawyer will often charge an hourly rate for all of the fees since this will give him more money for his time in most cases.

The hourly fees usually range from seventy-five to two hundred fifty dollars, depending on the quality of the lawyer and the amount of experience he has had in divorce proceedings. A cheap divorce lawyer will be less expensive than this, but he will usually have even less experience and will often end up taking longer to settle the case than a more experienced lawyer who costs more initially, thus making the two comparable. One way to help to cut cost with a better lawyer is to allow the paralegal or assistant attorney to settle certain issues so that it is done under the lawyer’s oversight but at a lesser rate, thus costing the individual less money in the long run for quality services.
